Grandfathered plans IFR amendment, request for comment

On November 17, amendments to the interim final rule (IFR) on grandfathered plans will be published in the federal register with request for comment. The major change it makes to the IFR is that it will allow employers to change issuers without losing grandfathered status.

Comments due on appeals rule – Employers say too costly

IRS releases draft form for claiming small business health care tax credit

The Internal Revenue Service has released a draft form for small businesses and tax-exempted organizations to calculate the tax credit created under the health reform law for small businesses that offer health care benefits to their employees.

IRS issues guidance on drug purchases and FSAs and HSAs

The Internal Revenue Service has released a guidance reflecting the changes made by the health reform law, which specifies that only prescribed drugs will be reimbursable by flexible spending arrangements (FSAs) and health reimbursement arrangements (HRAs) or considered qualifying medical expenses under health savings accounts (HSAs) and Archer Medical Savings Accounts (Archer MSAs). The only exception to this new rule is insulin, even if purchased without a prescription.

IRS to accept Qualifying Therapeutic Discovery Project Program applications

The Internal Revenue Service has announced that it will begin accepting applications for certification for tax credits or grants under the Qualifying Therapeutic Discovery Project Program created by the health reform law. According to the agency, these grants are available for projects that “show significant potential to produce new cost-saving therapies, create U.S. jobs, and increase U.S. competitiveness.”

IRS announces providers in underserved communities may be eligible for tax refund

The Internal Revenue Service has announced that providers working in underserved areas may be eligible for a refund on their 2009 taxes because the health reform law expanded the tax exclusion “to include any state loan repayment or loan forgiveness programs intended to increase the availability of health care services in underserved areas or health professional shortage areas.”
